Certain highly qualified profiles or with a specialization in a specific area of work are not easy to find. For this reason, companies are not closed to looking for employees in other countries. With the benefits offered by the Entrepreneurs Law 14/2013, this attraction of foreign talent to Spanish companies and encouraging internationalization is sought.

The hiring of highly qualified personnel, especially outside the European Union, involves the processing of work permits and special visas for this type of profile. Our lawyers specialized in international mobility know the requirements and the strategy to follow in order to obtain all the necessary approvals and permits in the best possible time.

The permit for the hiring of highly qualified professionals is granted when a company is interested in incorporating this type of worker into its workforce in Spanish territory.

The permit will be favorable if the person to be hired is in one of the following situations: managerial personnel for a company that meets certain characteristics; the employee will be part of a business project of general interest; the candidates are graduates and postgraduates from prestigious centers.

 

The interested company is the one who must initiate the procedure for the concession of the hiring permit, or a legal representative. In this case, our team of lawyers would be in charge of these procedures.

As it is linked to a specific company, it is not possible to obtain a hiring permit for this type of profile if there is no job offer.

The new Startup Law increased the duration of this permit to 3 years. In other words, with a single initial procedure, the worker can reside in Spain during that time.

Once this permit has been obtained, both the hired professional and the family members can benefit from legal residence in Spain, without geographical limitation; the possibility of renewing the permit; the possibility of requesting family reunification; and ultimately, even obtaining Spanish nationality by residence.

With the appropriate advice and lawyers specialized in the procedures for PAC hiring permits, the estimated time is 20 working days if it is managed from Spain.

In case of being managed from the country of origin, there is a first authorization of 20 days and a subsequent period of 10 days to obtain the visa from the Consulate.

In the case of workers holding a permit for highly qualified professionals, such permit is linked to the company that hires them. This implies that, if the employment relationship that motivated its concession is extinguished, the permit will lose its validity.

From that moment on, the person will have a period of 90 days to request a new permit that will allow him/her to maintain his/her regular situation in Spain. If he/she does not do so within this period, he/she will be in an irregular situation.
